New York’s legal cannabis numbers, in one place. How many licensed dispensaries are open and where, what the market sells, what Albany collects in tax, which towns opted out of retail, and when the Cannabis Control Board meets next. Every figure comes from the Office of Cannabis Management (OCM), the state Tax Department or New York’s open-data portal. Each one links to its source and carries an “as of” date. We refresh it weekly.

Two counts, two meanings. 729 is the number OCM printed on its Dispensary Location Verification page on October 5, 2026. The table on that page had 728 rows: 3 delivery-only services with no storefront, 41 microbusinesses with a retail location, and one shop listed twice. That leaves 724 storefronts, which is what our county and town tables count. Separately, OCM told the Board on Oct 1 that 712 of 1,039 licensed retailers had reported opening. The directory can run ahead of that figure between meetings.
Not published by OCM: monthly sales (OCM moved to quarterly reporting in August 2026), sales by county or town, and a certified full-year 2025 adult-use total. We’ll add them if OCM posts them.

Retail sales: by year and latest quarter

Legal adult-use sales in New York began on Dec. 29, 2022, at Housing Works Cannabis in Manhattan, according to OCM. Adult-use sales reached $882.1M in 2024 and $1.48B in the first 11 months of 2025. Medical sales fell each year over the same stretch. OCM now reports $4.1B in retail sales since the market opened.

Read the labels. OCM’s milestone figures don’t all measure the same thing. The $2.5 billion mark counts adult-use sales only. The $3.3 billion and $4.1 billion marks count all reported retail sales. The Market Landscape dashboard combines adult-use and medical sales unless you filter by license type. Its “Total Retail Sales” year-to-date figure read $1.41B on October 5, 2026.

Taxes on NY cannabis

Three taxes apply to a legal adult-use purchase. Distributors pay 9% when they sell to a store. Shoppers pay 13% at the register: a 9% state tax and a 4% local tax. Adult-use cannabis is exempt from regular sales tax. From April 2023 through November 2025, the state collected $340.6M in cannabis taxes, state and local, adult-use and medical combined.

Where the money goes: after the state covers program costs, the Cannabis Revenue Fund splits what’s left 40% to schools through the State Lottery Fund, 40% to the Community Grants Reinvestment Fund and 20% to drug treatment and public education. OCM fact sheet

Dispensaries by county: 55 of 62 counties

New York City has 314 of the state’s 724 storefronts. New York (Manhattan) leads all counties with 102. Outside the city, Erie County leads with 55, led by Buffalo with 20. Seven counties have no licensed storefront: Chenango, Hamilton, Lewis, Madison, Nassau, Schuyler, Wyoming. In Nassau, every town and city opted out of retail sales. The counts are TSR’s tally of OCM’s directory, placed in counties using OCM’s own license data. OCM does not publish sales by county.

By region: sales, stores and prices

OCM reports regional data using Empire State Development’s 10 economic regions. New York City led adult-use sales through November 2025 with $1.07B, more than the next four regions combined. Long Island had the highest average price per item in the third quarter of 2025 ($41.41). Western New York had the lowest ($26.39).

Where retail is allowed: local opt-outs

New York cities, towns and villages had until Dec. 31, 2021, to opt out of retail dispensaries, on-site consumption lounges or both. OCM’s official list shows 709 municipalities that opted out of retail dispensaries. All of them also opted out of on-site consumption. Another 129 opted out of on-site consumption only, for 838 on the list in all. Of the 709 retail opt-outs, 429 are towns, 273 are villages and 7 are cities. A municipality can opt back in at any time by repealing its law. Once it does, it cannot opt out again.

Prices: what an item costs

Prices are falling but still high by national standards. OCM says the average adult-use item sold for $32.15 in the third quarter of 2025. That’s down from a peak of $39.34 in early 2024, a drop of about 15%. OCM also says shoppers downstate pay about 10% more than upstate. This is market data, not a shopping guide. TSR sells apparel only.

Medical program snapshot

New York had 81,500 active medical cannabis patients and 31 open medical dispensaries on November 30, 2025. That’s down from 103,688 active patients in November 2024 (OCM 2025 Annual Report).

Licenses and store openings

The Cannabis Control Board approves licenses at its monthly meetings. As of Oct. 1, 2026, New York had issued 1,981 adult-use licenses, and 56% went to social and economic equity applicants. Of 1,039 licensed retailers, 712 had reported opening and 327 had not.

Yes. Since June 26, 2024, adults 21 and older may grow up to 3 mature and 3 immature plants each, with a limit of 6 mature and 6 immature plants per residence. Home-grown cannabis cannot be sold.

The Board’s remaining 2026 meetings are Thursday, Nov. 5, in Albany and Thursday, Dec. 3, in New York City. OCM posts the venue, agenda and livestream on its Cannabis Control Board page.

  • Dispensary counts: the headline is the number OCM prints on its Dispensary Location Verification page. For county and town tables we saved every row on that page on October 5, 2026, dropped delivery-only services and one repeated listing, and placed each storefront in a county by matching its street number and ZIP to OCM’s Current OCM Licenses file on NY Open Data. When there was no exact match, we used the county where most OCM licenses in that ZIP code sit, or placed the store by hand from its street address. Where OCM’s file put a store in a county that didn’t fit its address, we used the address county. We did this for five storefronts.
  • Sales: yearly figures come from the OCM 2025 Annual Report. The latest quarter, year-to-date and program-to-date totals come from OCM’s Oct. 1, 2026 Board update. OCM rounds these figures, and some combine adult-use and medical sales. Each table says which.
  • Tax: rates come from the NYS Tax Department and OCM. Collections come from the OCM Annual Report, which uses the Tax Department’s monthly collection reports and the state fiscal year (April–March).
  • Regions: OCM reports regional data by Empire State Development’s 10 economic regions. Our storefront counts group New York City’s five boroughs into one region to match.
  • Opt-outs: counted from OCM’s official opt-out spreadsheet. OCM updates it when a municipality tells OCM it repealed its opt-out.
  • Gaps: OCM does not publish monthly sales (since August 2026), sales by county or town, a per-gram flower price or a list of open consumption lounges. We mark these as not published. We don’t fill holes with guesses or third-party estimates.
